Terms of Service

These terms explain how estates, residents, administrators, and authorized users may use Pilotestate for dues collection, gate access, resident communication, and estate operations.

These terms are written for estate associations, resident administrators, security teams, and residents who use Pilotestate.

They are intended to align with Nigerian law, including the Nigeria Data Protection Act, 2023, where personal data is processed through the service.

1. Agreement to These Terms

By creating an account, accessing Pilotestate, requesting a demo, paying through the platform, or using any Pilotestate service, you agree to these Terms of Service. If you use Pilotestate on behalf of an estate, company, residents association, facility manager, or other organization, you confirm that you have authority to bind that organization.

If you do not agree with these terms, you should not use the service.

2. What Pilotestate Provides

Pilotestate provides estate operations tools that may include dues collection, payment records, digital gate passes, visitor verification, resident communication, reporting, administrative dashboards, and related support services.

Some features may depend on third-party providers such as payment processors, messaging providers, hosting providers, identity or security tools, and analytics services. Those providers may operate under their own terms and policies.

3. Accounts and Authorized Users

Estate administrators are responsible for approving users, assigning roles, keeping account information accurate, and ensuring that only authorized personnel can access resident, visitor, payment, or gate pass information.

Users must keep login details confidential and must notify Pilotestate promptly if they suspect unauthorized access, credential compromise, or misuse of the service.

4. Estate and Resident Data Responsibilities

Where an estate or administrator determines why and how resident, visitor, payment, or gate access data is processed, that estate or administrator may act as the data controller under the Nigeria Data Protection Act, 2023. Pilotestate may act as a processor or service provider for that data, depending on the feature and relationship involved.

Estates and administrators are responsible for collecting data lawfully, giving required notices to residents or visitors, obtaining valid consent where required, keeping data accurate, and using Pilotestate only for legitimate estate management purposes.

5. Payments, Pricing, and Fees

Pilotestate pricing may be billed yearly based on estate size, selected modules, support level, or another agreed commercial arrangement. Fees, payment timelines, taxes, transaction charges, and renewal terms may be stated on the pricing page, invoice, order form, or separate agreement.

Payments made through third-party processors are subject to successful authorization, fraud checks, settlement rules, chargeback rules, and applicable financial regulations. Pilotestate is not responsible for delays or failures caused by banks, payment gateways, network providers, or incorrect payment details supplied by users.

6. Acceptable Use

You must not use Pilotestate to commit fraud, harass residents, send unlawful or misleading communications, bypass security controls, scrape or extract data without permission, interfere with the service, upload malicious code, or access information you are not authorized to view.

You must not use resident, visitor, payment, or gate pass data for unrelated marketing, political messaging, profiling, resale, or any purpose that is not compatible with lawful estate operations and applicable privacy requirements.

7. Communications

Pilotestate may help estates send service-related messages by email, SMS, WhatsApp, or in-app notification. These may include dues reminders, payment receipts, visitor access notices, gate pass updates, support replies, and security alerts.

Estate administrators are responsible for making sure their communication practices are lawful, accurate, and limited to appropriate estate management purposes.

8. Intellectual Property

Pilotestate, its logo, platform design, software, workflows, content, documentation, and related brand assets belong to Pilotestate or its licensors. These terms do not transfer ownership of Pilotestate intellectual property to any estate, administrator, resident, or user.

Users retain ownership of data they submit, subject to the rights needed for Pilotestate to host, process, transmit, display, secure, support, and improve the service.

9. Availability, Support, and Changes

Pilotestate works to keep the service secure and available, but we do not guarantee uninterrupted access. Maintenance, upgrades, internet outages, third-party failures, security events, or force majeure events may affect service availability.

We may improve, modify, suspend, or discontinue features where reasonably necessary. If a change materially affects an active subscription, we will try to provide reasonable notice where practicable.

10. Suspension and Termination

We may suspend or terminate access if fees are unpaid, the service is misused, security is at risk, legal obligations require it, or these terms are materially breached.

After termination, access to the service may stop. Data export, retention, deletion, or handover will be handled according to applicable law, the Privacy Policy, and any separate agreement with the estate.

11. Limitation of Liability

To the fullest extent allowed by applicable Nigerian law, Pilotestate is not liable for indirect, incidental, special, consequential, punitive, or exemplary losses, including loss of profit, revenue, goodwill, data, or business opportunity.

Nothing in these terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or obligations that applicable law does not permit us to exclude.

12. Governing Law and Disputes

These terms are governed by the laws of the Federal Republic of Nigeria. The parties should first try to resolve disputes in good faith through written notice and reasonable discussion.

If a dispute cannot be resolved informally, it may be referred to the courts or other competent dispute resolution forum in Nigeria, unless a separate written agreement states otherwise.
